GOOROO CONTROLLERS GENERAL TERMS AND CONDITIONS JANUARY 1, 2024


The following terms and conditions apply between the company "GOOROO CONTROLLERS" whose registered office is located at 25 rue saint maur 75011 Paris in France ("the seller"), and a buyer of legal age and capacity ("the buyer").
These terms and conditions apply solely to products sold by the seller on its website. These terms and conditions are initially drafted in French. In the event of any discrepancy with the translated version, the French version shall prevail.


PRICES & TAXES
The prices indicated on the site are in euros, exclusive of taxes and delivery charges.
The seller reserves the right to modify the price of its products at any time, but undertakes to apply the price in force at the time of the buyer's order.
Taxes and delivery charges vary according to the buyer's country.
In the event of an order to a country other than metropolitan France, the buyer is responsible for any customs duties or other local taxes, import duties or state taxes that may be due. These rights and sums are not the responsibility of the Vendor.


PAYMENT
Validation of the order constitutes an obligation on the part of the purchaser to purchase at the price indicated by the Vendor on the gooroocontrollers.com website at the time the order is placed.
Payment is made at the time the order is placed, according to the methods proposed by the seller before the order is validated.


GUARANTEE
As the LIOBOX is a hand-assembled product, slight visual imperfections may be observed on the product. However, these imperfections do not affect the proper functioning of the equipment or its general aesthetics.
Legal warranty of conformity (articles L.217- 7 to L.217-14 of the French Consumer Code)
The seller undertakes to offer the purchaser a product that conforms to the contract and to the description given on the gooroocontrollers.com website, as well as to the technical documentation available on its website. This warranty extends for 2 years from the date of purchase. In the event of a lack of conformity, the seller undertakes to offer a replacement product or repair, at the buyer's discretion, unless this would incur a manifestly disproportionate cost for the seller, taking into account the value of the good or the importance of the defect.
Legal warranty against hidden defects (articles 1641 to 1649 of the French Civil Code)
The seller guarantees against hidden defects in the product sold which render it unfit for its intended use, or which reduce this use to such an extent that the buyer would not have purchased it, or would only have paid a lower price for it, had he been aware of them.
This legal warranty covers all costs incurred by hidden defects.

The seller guarantees against hidden defects in the product sold which render it unfit for its intended use, or which reduce this use to such an extent that the buyer would not have purchased it, or would only have paid a lower price for it, had he been aware of them.
This legal warranty covers all costs incurred by hidden defects.
The seller is not liable for apparent defects of which the buyer has been able to convince himself, but for hidden defects, even if he was unaware of them, unless he has stipulated that he will not be bound by any warranty. The defect must predate the sale and render the goods unfit for their intended use.
In the event of equipment failure, the buyer must return the product to the seller for diagnosis at his own expense. In the event of a breakdown due to improper use of the equipment, the seller will send the purchaser a repair estimate, indicating the estimated time required. If the purchaser accepts the estimate, a pro-forma invoice will be sent for payment. The product will be returned repaired or replaced on receipt of payment. Delivery costs will be borne by the purchaser.
In the event of an independent breakdown unrelated to misuse, the manufacturer's warranty will apply and the seller will repair or replace the product free of charge. Shipping costs will be borne by the seller.


RIGHT OF WITHDRAWAL
The buyer may exercise his right of withdrawal within 14 days of receipt of the product.
After notifying the seller of his intention to withdraw, the buyer has 14 days to send the product to the following address:

The buyer must return the product and its accessories in their original condition and complete, allowing remarketing in new condition and if possible accompanied by the purchase invoice.

INTELLECTUAL PROPERTY
Any use of the Products, in whole or in part, for purposes other than those for which they are intended is strictly forbidden.
All media available on the website or documentation made available by the seller are reserved as intellectual property.
The seller has full and complete ownership of the SOFTWARE embedded in its products, as well as the scripts supplied at the time of purchase. The sale of the seller's products to the buyer does not constitute a sale of the embedded software or the corresponding script, or a transfer of intellectual property.
The seller grants a non-exclusive license to use the software under the terms and conditions of this contract.
The purchaser is not authorized to rent, lend or license the software.

RESPONSIBILITIES
Electronic products sold on the www.gooroocontrollers.com website comply with French legislation. The seller cannot be held responsible in the event of non-compliance with the legislation of the country to which the product is delivered.
The seller guarantees that its electronic products comply with CE and FCC certifications and may therefore be marketed and used in European Union countries and the United States of America.
The photos and illustrations of products on the website or in any technical or commercial documentation are for information purposes only.
Electronic products sold by the seller, like all electronic products, are subject to potential breakdowns.
The seller cannot be held responsible for direct or indirect damage caused by a malfunction of one of its products. The use of these products is the responsibility of the purchaser.
The Buyer is solely responsible for the use he makes of the Product and shall not hold the Seller liable for any claim and/or proceedings made against him, arising out of or in connection with such use. In no event shall the Seller be liable for damages resulting from misuse by the Buyer.

The purchaser is responsible for backing up the data contained in the equipment purchased. It is the buyer's responsibility to check, before ordering, the compatibility of his equipment and software with the product he is purchasing. The seller cannot be held responsible in the event of equipment malfunction due to software or hardware incompatibility.
The seller undertakes to provide the purchaser with free updates to the embedded software, via a download from its website.
